LEGAL
Terms of Use
These terms govern access to OPENSTAND, including browsing stands, requesting orders, and using marketplace tools.
Effective August 26, 2026
1. The OPENSTAND service
OPENSTAND provides software that helps independent sellers publish self-service storefronts and helps buyers discover and request goods for local pickup. OPENSTAND is a marketplace technology provider—not the seller, manufacturer, packager, payment processor, employer, agent, or guarantor of products listed by sellers.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter a contract to operate a stand. You are responsible for activity through your seller access and for keeping access credentials secure. Buyers may browse and request orders without creating an account.
3. Orders, payments, and fulfillment
An order request is an agreement directly between buyer and seller when accepted by the seller. Prices, availability, pickup timing, refunds, substitutions, taxes, and payment terms are set by the seller. Payments occur through the seller’s selected provider or at pickup; OPENSTAND does not receive, hold, or transmit purchase funds.
4. Marketplace conduct
You may not use OPENSTAND to sell illegal, stolen, recalled, counterfeit, unsafe, age-restricted, regulated, or prohibited goods; misrepresent products or identity; harass others; collect data without permission; interfere with the service; or use the service for fraud. We may restrict listings or access when reasonably necessary to protect users or the platform.
5. Seller content
Sellers retain ownership of photos, descriptions, names, and other content they submit. Sellers grant OPENSTAND a nonexclusive, worldwide, royalty-free license to host, reproduce, resize, display, and distribute that content only as needed to operate, market, and share their storefronts and the service.
6. Disclaimers
The service is provided “as is” and “as available.” To the fullest extent permitted by law, OPENSTAND disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not inspect products, verify every seller statement, guarantee availability, or warrant that a transaction will be completed.
7. Liability
To the fullest extent permitted by law, OPENSTAND is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss arising from products, pickup interactions, payments, seller conduct, unavailable service, or third-party providers. Rights that cannot legally be limited remain unaffected.
8. Changes and termination
We may update the service or these terms. Material changes will be posted with a revised effective date. Continued use after changes become effective means acceptance. You may stop using the service at any time; we may suspend access for violation, risk, or legal necessity.
9. General
If any provision is unenforceable, the remaining terms continue. Failure to enforce a provision is not a waiver. These terms, together with the Privacy Policy and applicable seller terms, form the agreement for use of OPENSTAND.
